Business orders are placed exclusively on the basis of individually agreed terms.<\/p>\n      <p>(5)  These Terms apply exclusively. Deviating, conflicting or supplementary terms and conditions shall only become part of the contract with our express written consent.<\/p>\n      <p>(6)  The contract language is German.<\/p>\n    \n      <h2>\u00a7 2 Conclusion of Contract<\/h2>\n      <p>(1)  The presentation of products in the Online Shop does not constitute a binding offer, but a non-binding invitation to the Customer to submit an order.<\/p>\n      <p>(2)  By clicking the button labelled \"order with obligation to pay\" (\"zahlungspflichtig bestellen\") or a correspondingly unambiguous wording in the last step of the ordering process, you submit a binding offer to conclude a purchase contract for the goods in the shopping cart. Before submitting the order, you can review all entries at any time and correct them using the usual keyboard and mouse functions.<\/p>\n      <p>(3)  We will confirm receipt of your order immediately after it has been sent by e-mail (confirmation of receipt). This confirmation of receipt does not yet constitute acceptance of your contractual offer.<\/p>\n      <p>(4)  The purchase contract is concluded as soon as we declare acceptance of the order in a separate order confirmation or shipping confirmation e-mail, but at the latest upon delivery of the goods.<\/p>\n      <p>(5)  We store the text of the contract after conclusion of the contract; you will also receive the contents of your order by e-mail. You can view the current version of the Terms at <a \n  href=\"https:\/\/www.drperi.at\/agb\/\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.drperi.at\/agb\/<\/a>.<\/p>\n    \n      <h2>\u00a7 3 Prices, Taxes and Other Costs<\/h2>\n      <p>(1)  All prices stated in the Online Shop are in euros including the statutory Austrian value added tax at the rate of 20% pursuant to \u00a7 10(1) of the Austrian VAT Act 1994 (UStG 1994).<\/p>\n      <p>(2)  In addition to the prices indicated, shipping costs may be charged depending on the delivery area. The amount of the shipping costs and any further delivery costs will be shown separately before the conclusion of the order in the order overview and in the Shipping Terms.<\/p>\n      <p>(3)  For deliveries to countries outside the European Union, customs duties and import charges may additionally be incurred, which are to be borne by the Customer. We recommend that you inform yourself with the competent authorities about any additional costs before ordering.<\/p>\n\n      <h2>\u00a7 4 Payment Terms<\/h2>\n      <p>(1)  The payment methods available for your order will be shown to you before the conclusion of the order. A complete overview of accepted payment methods can be found in the Payment Methods.<\/p>\n      <p>(2)  Payment is due upon submission of the order.<\/p>\n      <p>(3)  In the event of a chargeback or return debit note for which the Customer is responsible, we are entitled to pass on the bank fees actually incurred by us through the payment service institution. These costs are not charged as a flat rate.<\/p>\n      <p>(4)  We are not obliged to deliver until the purchase price has been paid in full.<\/p>\n\n      <h2>\u00a7 5 Delivery and Passage of Risk<\/h2>\n      <p>(1)  Delivery is made in accordance with the conditions specified in the Online Shop and in the Shipping Terms from the shipping warehouse in Vienna.<\/p>\n      <p>(2)  We deliver to the countries listed in the Shipping Terms. Delivery to parcel stations or post office boxes is only possible if this is supported by the chosen shipping service provider.<\/p>\n      <p>(3)  <strong>Passage of risk:<\/strong> When the goods are dispatched, the risk of accidental loss and accidental deterioration of the goods pursuant to \u00a7 7b KSchG passes to you only upon handover of the goods to you. If you are in default of acceptance, default of acceptance is equivalent to handover.<\/p>\n      <p>(4)  Specific delivery times, shipping service providers, shipping costs and the procedure in the event of delivery delays are set out in the Shipping Terms.<\/p>\n\n      <h2>\u00a7 6 Retention of Title<\/h2>\n      <p>(1)  The delivered goods remain our property until the purchase price (including all ancillary costs) has been paid in full.<\/p>\n\n      <h2>\u00a7 7 Right of Withdrawal (Right of Cancellation under FAGG)<\/h2>\n      <p>(1)  Consumers are entitled to a statutory right of withdrawal under the provisions of the Austrian Distance and Off-Premises Contracts Act (FAGG). The complete instructions \u2014 including the withdrawal period, addressee, consequences and model withdrawal form \u2014 can be found in the Withdrawal Instructions.<\/p>\n      <p>(2)  <strong>Important note on the exclusion of the right of withdrawal (\u00a7 18(1)(5) FAGG \u2014 hygiene exception):<\/strong> The right of withdrawal does not exist for contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. This exception applies in particular to the cosmetic products distributed by us as soon as their protective film, original seal or safety closure has been removed by you.<\/p>\n      <p>(3)  From 19 June 2026, we will additionally provide you with an electronic withdrawal button (\"Withdraw contract\") in your customer account. Details can be found in the Withdrawal Instructions, Part 4.<\/p>\n\n      <h2>\u00a7 8 Warranty<\/h2>\n      <p>(1)  The statutory provisions of the Austrian Consumer Warranty Act (VGG, Federal Law Gazette I 175\/2021) as well as, additionally, the provisions of the Austrian Civil Code (ABGB) apply.<\/p>\n      <p>(2)  The warranty period is two years from the handover of the goods. Within the first year after handover, it is presumed that a defect that comes to light was already present at the time of handover.<\/p>\n      <p>(3)  You can report defects in the delivered goods to us informally, preferably by e-mail to <a href=\"mailto:office@drperi.at\">office@drperi.at<\/a>, stating your order number and a description of the defect.<\/p>\n      <p>(4)  In the event of a warranty claim, you are initially entitled to repair or replacement of the defective goods. If repair and replacement are impossible, involve considerable inconvenience for you, involve disproportionate effort, or if we refuse them, you may demand an appropriate price reduction or withdraw from the contract (rescission), provided that the defect is not minor.<\/p>\n      <p>(5)  We do not provide any guarantee going beyond the statutory warranty unless this is expressly declared in an individual case.<\/p>\n\n      <h2>\u00a7 9 Damages and Limitation of Liability<\/h2>\n      <p>(1)  We are liable without limitation for intent and gross negligence as well as for damages arising from injury to life, body or health based on a negligent breach of duty by us or an intentional or negligent breach of duty by our legal representatives or vicarious agents.<\/p>\n      <p>(2)  In the case of slight negligence, we are only liable for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you can regularly rely) and only for damage typical of the contract that is foreseeable.<\/p>\n      <p>(3)  Any liability under the Austrian Product Liability Act (PHG) remains unaffected.<\/p>\n      <p>(4)  Otherwise, our liability for damages caused by slight negligence is excluded.<\/p>\n\n      <h2>\u00a7 10 Information on Cosmetic Products<\/h2>\n      <p>(1)  We distribute exclusively cosmetic products within the meaning of Regulation (EC) No. 1223\/2009 on cosmetic products. Our products are not intended for the healing, alleviation or prevention of diseases; any effect claims are exclusively of a cosmetic nature.<\/p>\n      <p>(2)  <strong>Responsible person pursuant to Art. 5 of Regulation (EC) No. 1223\/2009:<\/strong> The person responsible for a product is indicated on the respective product packaging in accordance with Art. 19 of the Regulation. Insofar as The Cottage MedCos GmbH itself is designated as the responsible person for a product, we ensure in this function compliance with the obligations pursuant to Art. 3 (product safety), Art. 10 (product safety report), Art. 13 (notification in the Cosmetic Products Notification Portal) and Art. 19 (labelling) of the Regulation. Insofar as a third-party company is designated as the responsible person, the distributor's obligations pursuant to Art. 6 of the Regulation apply to us.<\/p>\n      <p>(3)  All ingredients (INCI) are shown on the product packaging and on the respective product detail page in the Online Shop. Please check them carefully before use for any intolerances or known allergens.<\/p>\n      <p>(4)  In the case of sensitive skin or skin prone to reactions, we recommend carrying out a tolerance test on a small, inconspicuous area of skin (e.g. inside of the forearm) before the first large-area application of a new product.<\/p>\n      <p>(5)  Please do not apply the product near the eyes or on injured or irritated skin, and observe the respective application and storage instructions on the product packaging. In the event of undesirable skin reactions, please discontinue use and consult a doctor if necessary.<\/p>\n      <p>(6)  <strong>Reporting of serious undesirable effects (Art. 23 of the Cosmetics Regulation):<\/strong> Should you observe a serious undesirable effect within the meaning of Art. 2(1)(p) of Regulation (EC) No. 1223\/2009 after using one of our products (e.g. a reaction requiring medical treatment, temporary or permanent functional impairment), please report this to <a href=\"mailto:office@drperi.at\">office@drperi.at<\/a>, stating the product, the batch number and a description of the event. The Cottage MedCos GmbH will forward such reports immediately to the competent authority as well as \u2014 insofar as not the responsible person for the product concerned itself \u2014 to the responsible person indicated on the product packaging.<\/p>\n\n      <h2>\u00a7 11 Data Protection<\/h2>\n      <p>(1)  The processing of your personal data is carried out in compliance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG 2018). Details on the nature, scope, purpose and legal basis of the processing as well as on your rights as a data subject can be found in our Privacy Policy at <a \n  href=\"https:\/\/www.drperi.at\/datenschutz\/\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.drperi.at\/datenschutz\/<\/a>.<\/p>\n\n      <h2>\u00a7 12 Newsletter<\/h2>\n      <p>(1)  If you have subscribed to our newsletter with your express consent, we use your e-mail address to send you information about our products, promotions and news.<\/p>\n      <p>(2)  Registration takes place via the double opt-in procedure through our subscription service provider Phorest Salon Software Ltd., Dublin, Ireland.<\/p>\n      <p>(3)  You can revoke your consent at any time with effect for the future, for example by clicking on the unsubscribe link in each newsletter or by sending an informal notification to <a href=\"mailto:office@drperi.at\">office@drperi.at<\/a>. Details of the data processing in connection with the newsletter dispatch can be found in the Privacy Policy.<\/p>\n\n      <h2>\u00a7 13 Alternative Dispute Resolution (\u00a7 19 AStG)<\/h2>\n      <p>(1)  The Cottage MedCos GmbH is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration body.<\/p>\n      <p>(2)  However, consumers have the option of voluntarily contacting the Internet Ombudsman Office (<a href=\"https:\/\/www.ombudsstelle.at\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.ombudsstelle.at<\/a>).<\/p>\n\n      <h2>\u00a7 14 Applicable Law and Place of Jurisdiction<\/h2>\n      <p>(1)  The contractual relationship shall be governed exclusively by the substantive law of the Republic of Austria, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules of private international law.<\/p>\n      <p>(2)  The mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected (Art. 6 of the Rome I Regulation).<\/p>\n      <p>(3)  For actions against consumers, the place of jurisdiction pursuant to \u00a7 14 KSchG applies: actions may only be brought before the court in whose district the consumer has their domicile, habitual residence or place of employment.<\/p>\n\n      <h2>\u00a7 15 Final Provisions<\/h2>\n      <p>(1)  Should individual provisions of these Terms be or become wholly or partially invalid, void or unenforceable, the validity of the remaining provisions shall not be affected thereby. The invalid provision shall be replaced by the statutory provision.<\/p>\n      <p>(2)  There are no verbal collateral agreements.
